TERMS OF SERVICE

Last updated: July 21, 2026

1. Overview

This website is operated by EMYERRE.

Throughout these Terms of Service, the terms “EMYERRE”, “we”, “us” and “our” refer to EMYERRE.

EMYERRE offers this website, including all information, products, features, tools and services available through it, to you conditioned upon your acceptance of these Terms of Service and all other policies referenced herein.

Our contact information is:

EMYERRE
Spyrou Kyprianou Avenue 14
3070 Lemesos
Cyprus

Email: contact@emyerre.com

By visiting our website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms of Service.

These Terms apply to all website visitors, customers and other users of the website.

Please read these Terms carefully before using the website or purchasing a product. If you do not agree with these Terms, you should not use the website or place an order.

2. Other Applicable Policies

These Terms of Service should be read together with our:

  • Return and Refund Policy;

  • Privacy Policy;

  • Shipping Policy;

  • Cookie Policy, where applicable;

  • Any product-specific terms displayed on the relevant product page;

  • Any additional notices presented during checkout.

These documents form part of the agreement between you and EMYERRE.

If there is a conflict between these Terms and a mandatory consumer protection law applicable to you, the mandatory law will prevail.

3. Eligibility

By using this website or placing an order, you confirm that:

  • You have reached the legal age required to enter into a binding contract in your country or region;

  • The information you provide is complete, accurate and current;

  • You are legally permitted to use the payment method submitted;

  • You will use the website and products only for lawful purposes.

If you are using the website on behalf of a company or another legal entity, you confirm that you have authority to bind that entity to these Terms.

4. Personal and Commercial Use

The website and its content are intended primarily for customers purchasing EMYERRE products.

You may not use our website, product photographs, descriptions, branding or other content for resale, reproduction, commercial exploitation or any other unauthorised commercial purpose.

We may limit or cancel quantities that reasonably appear to be purchased for unauthorised resale, fraudulent activity or abuse of promotional offers.

Nothing in this section limits rights that cannot legally be restricted.

5. Product Information

We make reasonable efforts to display product descriptions, colours, measurements, materials, photographs and other characteristics as accurately as possible.

However:

  • Colours may appear differently depending on the device, display settings and lighting;

  • Minor variations may occur between handmade or naturally textured materials;

  • Measurements may have reasonable manufacturing tolerances;

  • Product packaging may be updated without materially changing the product;

  • Images may include decorative objects that are not included with the product.

Such minor variations will not be treated as defects where the product remains materially consistent with its description.

Nothing in this section excludes your rights where a product is defective, materially different from its description, unsuitable for its stated purpose or otherwise non-conforming under applicable law.

6. Product Availability

All products are subject to availability.

Placing an item in your cart does not reserve it. A product may become unavailable before checkout is completed or before the order is accepted.

We may:

  • Limit the quantity of products available per customer, household, payment method or order;

  • Discontinue a product;

  • Correct inventory errors;

  • Refuse or cancel an order when a product is unavailable.

If we cannot fulfil an accepted and paid order, we will inform you and refund the affected amount to the original payment method.

Sale, promotional and liquidation products may have limited availability and may not be restocked.

7. Prices

Product prices are displayed on the website in the selected or applicable currency.

Prices may change without prior notice, but a price change will not affect an order that we have already accepted, except where there is an obvious pricing error.

The total amount payable will be displayed during checkout and may include, depending on the destination and checkout configuration:

  • Product price;

  • Applicable sales tax or VAT;

  • Shipping charges;

  • Duties or import taxes;

  • Other charges clearly disclosed before the order is submitted.

Where duties and import taxes are not collected during checkout, they may be charged separately by the destination country, customs authority or delivery carrier.

You are responsible only for charges that are properly disclosed or lawfully imposed.

8. Pricing and Website Errors

We try to ensure that prices and product information are accurate. However, typographical, technical, inventory or pricing errors may occasionally occur.

If an obvious error affects your order, we may contact you to:

  • Confirm the order at the correct price or with the correct information; or

  • Cancel the affected item or order and issue a refund.

We will not charge a higher price without your express agreement.

Nothing in this section allows us to cancel an order arbitrarily after a binding contract has been formed, where cancellation would violate applicable law.

9. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions displayed at the time of the offer.

Unless otherwise stated:

  • Discounts cannot be exchanged for cash;

  • Discounts cannot be applied retroactively;

  • Only one discount may be used per order;

  • Discounts cannot be combined;

  • Promotional offers may have expiration dates;

  • Minimum purchase requirements may apply;

  • Certain products may be excluded.

We may refuse or cancel a discount obtained through fraud, technical manipulation, duplicate accounts or other misuse.

Promotional, sale and liquidation products remain covered by all mandatory consumer rights.

10. Placing an Order

To place an order, you must:

  1. Select the products and available options;

  2. Add them to your cart;

  3. Provide accurate billing and delivery information;

  4. Select an available shipping method;

  5. Select a payment method;

  6. Review the total price and applicable policies;

  7. Submit the order.

You are responsible for checking the product, size, colour, quantity, delivery address and payment information before submitting the order.

After submission, you may receive an automatic order confirmation. This confirms that we have received your order but does not necessarily mean that the order has been accepted.

11. Order Acceptance and Contract Formation

Your submission of an order constitutes an offer to purchase the selected products.

Unless mandatory law provides otherwise, the purchase contract is formed when we:

  • Send you a shipping or dispatch confirmation; or

  • Otherwise expressly confirm that the order has been accepted.

We may decline an order before acceptance for legitimate reasons, including:

  • Product unavailability;

  • Payment authorisation failure;

  • Suspected fraud or unlawful activity;

  • An obvious pricing or product information error;

  • Delivery restrictions;

  • Breach of these Terms;

  • Unauthorised resale or promotional abuse.

If payment was collected for an order that we do not accept, we will refund the collected amount to the original payment method.

12. Order Confirmation

After receiving an order, we will provide an electronic confirmation containing or giving access to relevant order information.

You should review the confirmation promptly and contact us at contact@emyerre.com if any information appears incorrect.

Please keep the confirmation for your records.

13. Payment

Available payment methods are displayed during checkout and may vary by country, currency and device.

By submitting payment information, you confirm that:

  • You are authorised to use the selected payment method;

  • The information provided is accurate;

  • You authorise us and our payment providers to process the applicable charges.

Payment transactions may be processed by independent payment service providers. Their own terms and privacy practices may apply.

We may carry out payment verification or fraud-prevention checks before accepting or dispatching an order.

If a payment is declined, reversed or disputed, we may suspend or cancel the order where permitted by law.

14. Fraud Prevention

To protect customers and our business, we may review orders for suspected fraud, unauthorised payment use, identity theft, chargeback abuse or other unlawful activity.

We may request reasonable additional information to verify an order.

If verification cannot be completed, we may delay, refuse or cancel the order and refund any amount collected, subject to applicable law.

You must not place orders using false information, another person’s identity or a payment method you are not authorised to use.

15. Shipping and Delivery

Available delivery destinations, shipping methods, charges and estimated delivery periods are described during checkout or in our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Customs procedures;

  • Carrier delays;

  • Weather events;

  • Public holidays;

  • Natural disasters;

  • Strikes;

  • Government action;

  • Incorrect or incomplete delivery details;

  • Events of force majeure.

We will comply with mandatory delivery deadlines applicable to your purchase.

Where required by law, the risk of loss or damage passes to you only when you, or a person designated by you, physically receives the goods.

16. Delivery Information

You must provide a complete and accurate delivery address.

EMYERRE is not responsible for delays caused by incorrect or incomplete information provided by the customer, except where we failed to process a correction that we had accepted before dispatch.

If an order is returned because of an incorrect address, failed collection or unjustified refusal of delivery, reasonable additional costs may be charged or deducted from a refund where permitted by law.

This does not apply where the delivery is refused because the package is visibly damaged, the wrong product was sent or the customer is exercising a mandatory legal right.

17. Customs Duties and Import Taxes

International orders may be subject to customs duties, import taxes, brokerage charges or other governmental fees.

Whether these charges are collected at checkout or upon importation depends on the destination and shipping method.

The customer may be responsible for charges not collected by EMYERRE during checkout, provided this responsibility was properly disclosed and is permitted under applicable law.

Customs authorities may delay, inspect or open packages. EMYERRE does not control customs procedures.

Customers must not ask EMYERRE to provide false product descriptions, values or customs declarations.

18. Cancellations

Contact contact@emyerre.com as soon as possible if you wish to cancel or modify an order.

We will try to accommodate the request but cannot guarantee cancellation or modification after processing or dispatch has begun.

If the order has already been dispatched, you may need to receive it and use the return procedure described in our Return and Refund Policy.

This section does not limit any statutory right to cancel or withdraw from a distance contract.

19. Returns, Refunds and Exchanges

Returns, refunds, exchanges and statutory withdrawal requests are governed by our Return and Refund Policy.

Customers must follow the procedures and time limits described in that policy.

Nothing in these Terms removes or limits rights concerning defective, incorrect or non-conforming products.

For eligible refunds, funds will generally be returned to the original payment method unless another method is required by law or expressly agreed with the customer.

20. Consumer Right of Withdrawal

Consumers who are legally entitled to withdraw from an online purchase may exercise that right within the applicable statutory period.

For qualifying consumers in the European Union and European Economic Area, this period is generally 14 days after receiving the goods.

Detailed withdrawal instructions and the model withdrawal form are available in our Return and Refund Policy.

This right is separate from legal remedies available for defective or non-conforming products.

21. Legal Guarantee and Product Conformity

Products supplied by EMYERRE must comply with the sales contract and with the mandatory consumer protection rules applicable to the purchase.

If a product is defective or non-conforming, you may be entitled to remedies such as:

  • Repair;

  • Replacement;

  • Price reduction;

  • Contract cancellation and refund.

The appropriate remedy and order in which remedies are available depend on applicable law and the circumstances of the claim.

Nothing in these Terms replaces or reduces a mandatory legal guarantee.

22. Accounts

Some website features may allow or require you to create a customer account.

You are responsible for:

  • Providing accurate account information;

  • Keeping your login credentials confidential;

  • Restricting access to your device;

  • Informing us promptly about suspected unauthorised access.

We may suspend or close an account used for fraud, abuse, unlawful activity or a serious breach of these Terms.

You may request account deletion by contacting contact@emyerre.com, subject to information we must retain for legal, tax, fraud-prevention or transaction-record purposes.

23. Reviews, Comments and Other Submissions

You may be able to submit reviews, photographs, comments, feedback or other content.

You must only submit content that:

  • Is truthful and based on your genuine experience;

  • Does not infringe intellectual property, privacy or other rights;

  • Is not defamatory, threatening, discriminatory, obscene or unlawful;

  • Does not contain malware, spam or deceptive advertising;

  • Does not include another person’s confidential information without permission.

You retain ownership of your original content.

By submitting content for publication, you grant EMYERRE a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, translate and use that content for operating and promoting EMYERRE, subject to applicable privacy and consumer laws.

Where permitted, you may withdraw permission for future use by contacting us. Withdrawal will not affect lawful use that occurred before the request.

We may moderate or remove content that violates these Terms or applicable law. We will not manipulate reviews in a misleading manner.

24. Intellectual Property

The website and its content, including:

  • The EMYERRE name and branding;

  • Logos;

  • Product photographs;

  • Videos;

  • Graphics;

  • Layouts;

  • Product descriptions;

  • Written content;

  • Designs;

  • Software and website elements,

are owned by or licensed to EMYERRE and are protected by applicable intellectual property laws.

You may access and use the website for personal, lawful shopping purposes.

Without prior written permission, you may not:

  • Copy or republish website content;

  • Use our photographs or videos commercially;

  • Reproduce our branding;

  • Create derivative commercial materials;

  • Scrape or systematically extract website data;

  • Impersonate EMYERRE;

  • Use our intellectual property in advertising, domains, social media accounts or marketplace listings.

No licence is granted except the limited personal-use right expressly described in these Terms.

25. Prohibited Uses

You must not use the website or services:

  • For unlawful, fraudulent or deceptive purposes;

  • To violate consumer, intellectual property, privacy or data protection laws;

  • To transmit malware or harmful code;

  • To gain unauthorised access to systems or accounts;

  • To interfere with website security or operation;

  • To collect personal data without lawful authority;

  • To send spam or unsolicited advertising;

  • To impersonate another person or EMYERRE;

  • To submit false orders or payment disputes;

  • To automate purchases in a manner that disrupts normal customers;

  • To manipulate promotions, reviews, pricing or website functions;

  • To harass, threaten or discriminate against another person.

We may restrict access where reasonably necessary to protect the website, customers or our legal rights.

26. Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment providers, shipping carriers, analytics services, social media platforms and other technology providers.

Third-party websites and services are governed by their own terms and privacy policies.

EMYERRE is not responsible for independent third-party content, services or actions outside our reasonable control.

However, this section does not remove responsibility that EMYERRE cannot legally exclude, including responsibility for service providers acting on our behalf where applicable.

You should review third-party terms before using an external service.

27. Website Availability

We aim to keep the website available and functioning correctly, but continuous or error-free access cannot be guaranteed.

We may temporarily suspend access for:

  • Maintenance;

  • Security updates;

  • Technical problems;

  • Legal compliance;

  • Events outside our reasonable control.

We may modify website features without notice, provided that doing so does not unlawfully affect an existing order or contract.

28. Accuracy of General Information

General information published on the website is provided for informational purposes.

We make reasonable efforts to keep it accurate and current, but information may occasionally become outdated.

Product information, prices and contractual terms shown during checkout will take priority over general promotional or editorial content where there is an inconsistency, without limiting rights arising from misleading statements or applicable consumer law.

29. Privacy and Data Protection

Our collection and use of personal information are described in our Privacy Policy.

By using the website, you acknowledge that personal data may be processed as necessary to:

  • Operate the website;

  • Process payments;

  • Fulfil orders;

  • Provide customer support;

  • Prevent fraud;

  • Comply with legal obligations.

Where required, additional consent will be requested separately.

These Terms do not replace our Privacy Policy or reduce your data protection rights.

30. Disclaimers

We do not guarantee that the website will always be uninterrupted, secure or free from technical errors.

To the maximum extent permitted by law, the website is provided on an “as available” basis.

However, nothing in these Terms excludes or limits:

  • Mandatory consumer guarantees;

  • Liability for fraud or fraudulent misrepresentation;

  • Liability for death or personal injury caused by negligence;

  • Liability for intentional misconduct or gross negligence where it cannot be excluded;

  • Data protection obligations;

  • Any other liability or right that cannot legally be excluded.

Products will remain subject to the descriptions, guarantees and conformity requirements applicable to the sales contract.

31. Limitation of Liability

To the maximum extent permitted by law, EMYERRE will not be liable for indirect or unforeseeable losses that are not the natural result of a breach of these Terms.

For consumers, a loss is foreseeable when it was an obvious consequence of the breach or was contemplated by both parties when the contract was formed.

EMYERRE is not responsible for business losses arising from purchases made primarily for commercial or resale purposes, including lost profit, lost revenue or lost business opportunity, except where such liability cannot legally be excluded.

Nothing in these Terms limits liability for:

  • Products that are defective or non-conforming;

  • Failure to perform a mandatory legal obligation;

  • Fraud;

  • Intentional misconduct;

  • Death or personal injury caused by negligence;

  • Any other liability that cannot be limited under applicable law.

32. Indemnification

If you use the website for commercial purposes or in a manner that violates these Terms, you agree, to the extent permitted by law, to compensate EMYERRE for reasonable losses, claims and expenses directly caused by your unlawful conduct or material breach.

This provision does not apply to ordinary consumer use and does not require a consumer to compensate EMYERRE for matters outside the consumer’s control or legal responsibility.

33. Events Outside Our Control

Neither party will be responsible for a delay or failure caused by an event outside that party’s reasonable control.

Such events may include natural disasters, serious transport disruption, war, terrorism, epidemics, government restrictions, widespread telecommunications failures, labour disputes or carrier interruptions.

This section does not remove any right to a refund or contract termination that applies when delivery or performance is not completed within a mandatory legal deadline.

34. Changes to These Terms

We may update these Terms to reflect:

  • Changes in law;

  • Changes in our business or services;

  • New website features;

  • Security requirements;

  • Clarifications or corrections.

The updated version will be published on this page with a revised “Last updated” date.

Changes will apply prospectively and will not retroactively alter an order or contract already accepted, unless:

  • The change is required by law;

  • The customer expressly agrees; or

  • The change benefits the customer without reducing existing rights.

You should review these Terms periodically.

35. Suspension or Termination

We may suspend or terminate access to the website where reasonably necessary because of:

  • Serious or repeated violations of these Terms;

  • Fraud or suspected unlawful activity;

  • Threats to website security;

  • Legal or regulatory requirements.

Termination of website access will not automatically cancel existing orders, payment obligations, refunds or consumer rights.

Provisions intended to survive termination, including intellectual property, payment obligations and dispute provisions, will remain effective.

36. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or interpreted only to the extent necessary.

The remaining provisions will continue in effect.

For consumers, an invalid term will not be replaced in a way that reduces mandatory rights.

37. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we permanently waive the right to enforce it later.

A waiver will be effective only for the specific matter to which it relates.

38. Transfer of Rights

You may not transfer your contractual rights or obligations to another person without our consent, except where applicable law permits such a transfer.

We may transfer our rights or obligations to another business as part of a lawful sale, restructuring or transfer of the EMYERRE business.

Any transfer by EMYERRE must not reduce your consumer rights, guarantees, refund rights or ability to enforce an existing contract.

39. Entire Agreement

These Terms, together with the policies and information incorporated by reference, constitute the agreement between you and EMYERRE concerning your use of the website and purchase of products.

They do not exclude representations or information that form part of the contract under mandatory consumer law.

40. Governing Law

These Terms and contracts concluded with EMYERRE are governed by the laws of Cyprus, without prejudice to mandatory consumer protection rules applicable in the country where you habitually reside.

If you are a consumer, this choice of law does not deprive you of protections that cannot be excluded under the law of your country of residence.

41. Disputes and Jurisdiction

We encourage customers to contact us first so that we can try to resolve any concern directly.

Contact:

contact@emyerre.com

If a dispute cannot be resolved informally, the courts of Cyprus may have jurisdiction.

However, consumers retain the right to bring proceedings before any court that has jurisdiction under mandatory consumer law, including, where applicable, the courts of the country where the consumer resides.

Nothing in these Terms requires a consumer to waive a mandatory right to access a court or another legally available dispute-resolution procedure.

42. Language

These Terms may be translated into other languages.

Where permitted by law, the English version will be used to interpret the Terms if there is an inconsistency between translations.

This provision does not apply where local law requires the consumer’s language version to prevail or requires contractual information to be provided in a specific language.
